Should projected business returns be used to describe EB-5 costs?

THE DIRECT ANSWER

No. The investment, private project expenses, professional services, and government charges should be identified separately from any forecast.

Use a complete capital ledger

A project offering with several payment stages should be analysed from the actual proposal, not from an abbreviated label in an email or a planning spreadsheet. EB-5 requires qualifying capital at risk and job-creation evidence; an estimated distribution, repayment schedule, or promotional projection does not reduce the need to document the required investment and process costs. Start with the facts that exist today: names of parties, dates, duties, ownership rights, payments, and any condition that could change the arrangement.

A future intention can be useful context, but it should not be presented as an accomplished fact. Record capital contribution, administrative charges, escrow terms, document services, translations, government filing fees, travel, and later-condition-removal planning in separate columns. Keep originals available and make translations complete where the chosen process calls for them.

If a document is unavailable, explain the gap accurately rather than filling it with an assumption. Each family member can create additional document, medical, travel, or processing costs that should not be hidden in the principal’s investment figure. That person’s nationality, status record, age, planned study, and planned activity may require a separate review.

Government fees, filing locations, visa availability, and procedural instructions can change, so confirm them from the current official source before money is committed or travel is booked. Verify all current official fee instructions before payment and read private fee agreements for refund and risk provisions. The purpose of preparation is a clear factual record and an informed route comparison; it is not a promise that an officer will reach a particular result.
