U.S. visa support for Canadians
ready for what’s next.
Hypothetical example: a process-industry employer tells a pipefitter that a U.S. plant assignment is a "secondment," while a scaffolding contractor tells a subcontracted crew owner that the arrangement is a "partnership." Neither label decides anything on its own. A secondment that keeps the worker on home payroll and under the client's daily direction is still an employment relationship; a partnership where one party carries all the liability and is paid only once the turnaround closes may not be a partnership at all under immigration rules. St. Clair Township workers weighing a U.S. assignment should read the actual contract terms before assuming which route, if any, applies to their situation.
Six federal categories cover most U.S. work, transfer and investment situations available to Canadian citizens and residents: TN status for listed professions with prearranged employment, L-1A and L-1B for intracompany transfers of managers, executives and specialized-knowledge staff, E-2 status for treaty investors who develop and direct a real enterprise, EB-5 for immigrant investors funding a new commercial enterprise, and the Gold Card gift-based registration for applicants who separately qualify for lawful permanent residence. Each has its own facts to prove, and none of them turns on what a contract calls the arrangement rather than what it actually is.
Choose what brings you here. Leave with a short list of things to discuss—not another long form to fill out.
For a listed profession with a genuine, prearranged U.S. job offer, TN status is usually the fastest route to evaluate first, provided the profession's own degree, licence or experience rule is actually met.

Industrial contracting work around Lambton County's refining and petrochemical corridor already trains people to work against a fixed outage schedule, a signed scope of work and a client who inspects every deliverable before releasing payment. That discipline transfers directly to a U.S. immigration filing, which is also a fixed-scope exercise: a petition or application succeeds or fails on whether the evidence matches the category's own requirements, not on how strong the underlying relationship or opportunity feels to the people involved. Treating a filing with the same rigor as a turnaround work package, documented scope by scope, is what keeps a straightforward case from becoming a contested one.

A practical plan.
No promises we can’t keep.
Share the actual offer letter, secondment memo, subcontract or shareholder document, not a paraphrase of what it says. The category that fits often turns on a clause most applicants would not think to mention.
A short review identifies whether the arrangement is employment, a qualifying corporate transfer, an at-risk investment, or something else entirely, and flags any gap between what a document calls the arrangement and what it actually is.
Each category has its own proof requirements. The file is assembled against the standard that actually applies, rather than reused wholesale from a template built for a different route.
Submission is followed through to a decision, including any request for further evidence, so a gap identified after filing does not sit unanswered against a deadline.
None of these categories exists to reward effort or tenure on its own. TN status exists for a listed profession performed under a real, prearranged job offer; L-1 status exists for a genuine one-year employment relationship inside a qualifying corporate structure; E-2 status exists for capital that is actually at risk in a business the investor actually runs. A worker or owner in St. Clair Township is free to pursue any route the facts support, but that freedom runs through the specific evidence each category asks for, not through general experience, a general reputation for reliability, or a general willingness to relocate for the right project.
Find your pathwayShneur Herman, Jo Kubti and Alexander Paton work through each filing as a document-and-fact exercise: what the underlying relationship actually is, what evidence proves it, and what a specific applicant's record does or does not yet support. Consultations are remote; there is no local office and no walk-in appointment tied to this site. Where a case turns on a fact the team cannot verify from the record in front of them, such as how a contract characterizes a working relationship, they say so directly rather than assuming the label in the paperwork settles the underlying question.
Let’s connectArrange a remote consultation to discuss your next steps.
No. What matters is who directs the day-to-day work, who pays wages, and who can end the arrangement, not the word used in the internal memo. A secondment that keeps those features is ordinary employment for immigration purposes and should be documented as such.
Because immigration categories look at control, risk and compensation structure, not contract titles. A one-sided arrangement labeled a partnership can undermine an E-2 or L-1 filing if the underlying facts do not match what the label implies.
No. TN status, L-1 petitions, E-2 registration and EB-5 filings can all begin from Canada, and most Canadian TN applicants are processed at the port of entry itself rather than through a separate visa stamp.
It depends on the category and each family member's own plans. Spouses on E-2 and L-2 status can generally work; TD dependants on TN status can study but not work. Each derivative's situation is assessed on its own facts.
