Start with the EB-5 eligibility and application overview
The two current capital amounts
EB-5 investors currently commit either the standard amount or a reduced amount for a targeted employment area or qualifying infrastructure project. Both figures should be reverified against current official USCIS guidance before committing funds, since program amounts have changed over time and a sponsor's stated figure is not itself proof of the correct current amount.
What actually establishes targeted employment area status
A location being rural or outside a major metropolitan area is not, on its own, what qualifies a project for the reduced investment amount. Targeted employment area status depends on a designation tied to specific unemployment statistics for the relevant area, or on the project qualifying as an approved infrastructure project under the applicable rules, and that designation needs to be documented, not assumed from geography.
The document that actually proves the designation
A credible EB-5 offering should include a formal targeted employment area designation letter or equivalent supporting documentation tied to the specific project location and the underlying unemployment data or infrastructure approval relied upon. An investor should ask directly for this document rather than accepting a general statement that the project qualifies because of where it is located.
Jobs, source of funds and the investor's own role
Beyond the capital amount, EB-5 requires at least ten full-time jobs for qualifying U.S. workers, lawful source and lawful path of the invested funds, and the investor's engagement in management or policy formulation, which permitted limited-partner rights can satisfy. None of these requirements are relaxed simply because a project claims targeted employment area status. Conditional residence is part of the EB-5 sequence, not an afterthought. Hypothetical example: an investor considering a refrigerated-warehouse project must decide whether the economic report connects the specific investment to the required jobs before subscribing. The offering materials, economic analysis and funds trail should be retained because, when residence is granted, it is conditional for two years and a later petition is required to remove those conditions.
Direct and regional center methods are not interchangeable
Direct investors count actual employees of the new commercial enterprise; the indirect and induced jobs produced by economic modelling are available in regional centre cases, which is a substantial part of why regional centres exist. Alongside the money sits the requirement for at least ten qualifying full-time jobs, counted by methods that differ depending on whether the structure is standalone or regional-center. Direct positions require at least 35 hours weekly; contractors, nonimmigrants and the investor, spouse, sons or daughters are excluded from qualifying employees. For a direct enterprise, that may mean preserving hiring records, payroll, hours, and the position chart; a regional-center case can require different economic and allocation evidence.
