THE SHORT ANSWER

Hypothetical example: an applicant's Canadian citizenship application is pending while a U.S. start date approaches, and TN eligibility requires Canadian citizenship, not permanent residence. What is true on the day of entry or filing decides the route; a pending application, however far along, does not itself establish citizenship, so the U.S. plan needs to be sequenced around the applicant's actual, current status.

01

Why the pending application does not itself help

TN status is specifically available to Canadian citizens, and Canadian permanent residence, no matter how long-standing or how far a citizenship application has progressed, does not satisfy that requirement. An applicant with a citizenship application pending, perhaps close to a decision, is in immigration terms still a permanent resident until citizenship is actually granted, and any U.S. filing that assumes citizenship based on the pending application rather than confirmed status risks being built on a fact that is not yet true. The distinction matters even when a decision seems imminent, because timelines for citizenship processing can shift and an approaching U.S. start date should not be planned around an assumption.

02

Routes that do not depend on citizenship timing

Where the U.S. opportunity depends on an employment relationship with a qualifying corporate structure, L-1A or L-1B status may be available regardless of whether the applicant holds Canadian citizenship or permanent residence, since those categories key on the corporate relationship and employment history rather than treaty nationality. Similarly, an EB-5 investment does not require Canadian citizenship specifically. Where TN eligibility is the only practical route being considered, and citizenship has not yet been granted, the honest starting point is exploring whether an alternative category fits the underlying facts rather than waiting on a citizenship decision with an uncertain timeline.

03

Sequencing the U.S. start date around actual status

Rather than fixing a U.S. start date first and hoping citizenship arrives in time, the more reliable sequence is confirming actual citizenship status before committing to a TN-dependent start date, or building the U.S. plan around a category that does not depend on citizenship at all if the timing is genuinely uncertain. If citizenship is granted before the planned start date, TN status becomes straightforwardly available and the filing can proceed on that basis. If it is not yet granted when the opportunity requires a decision, the honest options are delaying the TN-based start, or evaluating whether the underlying employment or investment facts support a different category that does not turn on citizenship timing.
