Start with the L-1A eligibility and application overview
Prove the organization relationship
Hypothetical example: a foreign business and a U.S. company use the same marketing name, but their share registers identify different owners. The file needs the underlying legal relationship, such as parent, branch, subsidiary, or affiliate, supported by contemporaneous company records rather than branding or a presentation slide. The qualifying foreign employment ordinarily needs to be continuous for one year during the governing three-year reference period, with individual facts and absences assessed carefully. Payroll alone may not convey the role; pair it with job descriptions, reporting evidence, performance materials, calendars, and examples of decision-making. A gap, promotion, acquisition, or change of payroll entity is not necessarily fatal, but it should be explained with the records that show what actually happened. This is preferable to presenting a simplified employment history that cannot be reconciled.
Explain genuine managerial authority
Describe the people, function, budget, policies, or organization managed; identify the applicant’s discretion and the workers who deliver day-to-day services. A manager may supervise professionals, manage an essential function, or act at an executive level depending on the facts. The task is to show actual authority without inflating shared or limited powers. Managerial and executive capacity are not interchangeable labels. A functional manager may need evidence of managing an essential function at a senior level, while a personnel manager may need to show oversight rather than personal production. An executive account should identify policy, broad discretion, and organizational direction. The key is not to force a role into a category because the transferee is trusted or well paid. Describe the normal work week, the decision path, and the resources available to the person.
Recognize the new-office framework
For a new office, sufficient physical premises and a plan showing that the operation will support a managerial or executive role within one year are central. Initial approval is limited to one year. Keep projections labelled as projections and then use the developed business, staffing, revenue, and organizational evidence for any later request. The seven-year maximum limit needs to be considered early when a long U.S. expansion is contemplated. Previous time in related classifications, time outside the country, and the particular validity period can affect planning. Keep a travel log and all admission records, but do not calculate recapture from memory. Current official rules and the complete immigration history should inform the timetable. An extension request must still be supported by the qualifying relationship and role at the time it is made. Keep the petition narrative capable of being checked against ordinary company records. Board minutes, budgets, reporting lines, payroll, and policy approvals can be more persuasive when they existed for business reasons rather than being created only for the immigration file. That does not require a large company; it requires a truthful explanation of the organization that exists.
