Start with the EB-5 eligibility and application overview
Read the project documents as evidence, not advertising
Hypothetical example: a project brochure forecasts jobs and distributions, while the subscription agreement contains conditions and risk disclosures. Use the agreements, offering materials, entity records, and business or economic documentation to identify what is actually promised, what is projected, and what the investor controls. Commercial optimism does not establish an immigration outcome. EB-5 capital thresholds and project classifications must be checked against the law and current official guidance applicable to the case. The amount alone is not the whole analysis. The commercial enterprise, investment structure, lawful source, path of money, at-risk character, and job model must form a coherent record. Do not call an administrative charge qualifying capital merely because it appears on the same invoice. Private project terms should be read for risks, fees, refund provisions, conflicts, and the investor’s rights.
Document capital and its trail
The capital must meet the applicable requirements and remain subject to commercial risk. Trace its lawful origin and every material movement to the new commercial enterprise. A gift, loan, sale, or business distribution can require its own source documents and conditions. A concise chronology should allow each transfer to be matched to a bank record or closing document. Job creation must be assessed using the framework that applies to the investment. Direct employment evidence, construction or economic methodology, timing, and the relationship between capital and jobs can have different roles. A project statement that it “expects” jobs is not the same as evidence that the relevant requirement will be met. Ask what model is used, which professional assumptions support it, and what records will be available when conditions are later removed. Keep copies of every version because assumptions can change.
Examine qualifying job creation
The applicable job-creation analysis depends on the investment structure and governing rules. Identify the model being relied upon, the assumptions behind it, and the records expected to support it. Avoid importing an indirect-job methodology into a direct-investment case, or treating jobs described in a marketing deck as already created. Conditional residence is an important planning stage, not an administrative footnote. The investor should preserve records of the enterprise, capital, jobs, and any changes through the period required for a condition-removal filing. Filing timing is specific and should be calendared from the actual conditional-residence date. An approved petition or a completed capital transfer does not eliminate the need to complete subsequent visa, adjustment, admission, and condition-removal steps. Use current USCIS instructions for every filing decision.
Plan conditional residence honestly
Petition approval is a stage, not residence itself. The immigrant-visa or adjustment process, admissibility, visa availability, and the eventual conditional-residence result each have their own steps. The condition-removal petition has a defined filing window. Maintain the evidence needed for that later stage from the beginning instead of attempting to recreate it years later.
Keep family and finance questions apart
A household may share a bank account or a travel goal, but family inclusion and funding provenance are different analyses. Record relationships and age-sensitive facts alongside their supporting civil documents. Separately, identify who owns, transfers, guarantees, or lends money, including any obligations that continue after the investment is made.
