Invest in anew chapter.

Borrowed funds proposed for an EB-5 investment require a clear account of the borrower, lender, collateral, repayment and the investor’s rights. A loan approval does not by itself establish qualifying capital or its lawful source and path. The receiving investment must separately satisfy the at-risk and job-creation requirements. EB-5 review begins with the actual capital and the transaction that receives it, not a projected immigration result. Qualifying capital must be at risk, the investment must support the required job creation, and conditional residence follows only through the applicable immigrant process. A first review should produce a source-and-path chronology, a financing diagram, a project document list, and a calendar that separates investment events from immigration milestones.

01

Describe the financing without shorthand conclusions

Hypothetical example: an applicant plans to use a property-secured loan, but the property has several owners and the loan is not yet drawn. Record the actual parties, authority, obligations and conditions. Do not assume the words secured loan establish eligibility or that every family owner may direct all proceeds. For borrowed capital, identify who owns the collateral, who signs, what rights are transferred, when proceeds are released, and who remains liable. A term sheet can guide preparation, but it does not prove an executed funding event. The decisive record may be the loan agreement, security instrument, disbursement record, or property ownership record depending on the point at issue. Do not use a family relationship as a substitute for documented authority.

02

Trace the funds and relevant source evidence

Retain the agreement, security records, disbursement and transfer evidence appropriate to the arrangement. Explain the applicant’s rights and any intermediary payment. The final bank balance does not replace the underlying financing account, and a lender’s commercial approval is not an immigration determination. Create a chronological file beginning with the lawful origin of the money and ending with the receiving investment. Each account statement should have a purpose in that chain. Where a sale, loan, gift, dividend, or business distribution is involved, retain the record that explains both entitlement and movement. A review should flag unexplained gaps before the funds are sent, because later narrative cannot reliably replace contemporaneous proof.

03

Review the receiving project independently

Assess the EB-5 investment terms and qualifying job-creation basis. Avoid guarantees of return or approval and keep personal repayment risk separate from the immigration analysis. A project’s attractive forecast does not eliminate the borrower’s obligations or establish the lawful funding path. Evaluate the project documents on their own terms: subscription provisions, risk disclosures, deployment mechanics, and the stated job-creation methodology. The investment's risk profile and any repayment obligation are separate questions. No forecast settles the capital-at-risk or job requirement. The decision is whether the project documents and the investor's funding file each support their respective elements without guarantees that the law does not provide.

04

Apply the current capital and job conditions

Evaluate the loan’s borrower, collateral and repayment terms separately from the qualifying capital contributed to the new commercial enterprise. On September 7, 2026, the statutory minimums were US$1,050,000 generally and US$800,000 for a qualifying targeted employment area or infrastructure project; the next statutory adjustment starts January 1, 2027. The investment must remain at risk and support at least ten qualifying full-time jobs for each investor under the applicable method, which differs for standalone and regional-center cases. Document both the lawful origin of the money and every step by which it reached the investment rather than treating a final receipt as the whole record. Confirm the current capital threshold and whether the proposal qualifies for any lower statutory amount before committing money. Then identify the job evidence applicable to the investment structure and retain the documents that support it. At least ten qualifying full-time jobs per investor are generally required under the applicable rules. Do not combine direct and regional-center evidence casually; their methodologies differ.

05

Follow the residence and removal-of-conditions sequence

Approval of the investor petition does not itself confer residence; an immigrant-visa or adjustment process follows, subject to the applicant’s eligibility and visa availability. Successful EB-5 applicants first receive two years of conditional permanent residence. To remove those conditions, Form I-829 is generally filed during the 90-day period preceding the second anniversary of conditional residence, measured from the actual status date rather than a payment or return date. The investor must participate in management or policy formulation, and a spouse plus unmarried children under 21 may qualify as derivatives. Treat the immigration sequence as a separate calendar. Petition approval alone does not grant residence; visa availability and the next applicable step still matter. Residence initially carries conditions, and the removal-of-conditions filing uses the actual conditional-residence anniversary. A payment date, anticipated construction date, or projected distribution date cannot replace that status-based timeline.
