Your talent.A bigger stage.

TN is for a Canadian or Mexican citizen whose planned U.S. professional assignment fits an occupation in the USMCA list and whose qualifications meet that entry. The work must be arranged in advance and temporary in purpose. Canadian citizenship, a relevant degree or other listed qualification, a real employer or client arrangement, and the actual duties each deserve distinct evidence. It cannot be used to disguise self-directed activity for an enterprise the applicant solely or controllingly owns.

Start with the TN eligibility and application overview

01

Read the work before the title

Hypothetical example: a support letter calls an applicant a systems analyst, yet the weekly plan is dominated by routine help-desk tasks. The analysis should identify recurring duties, outputs, authority, and the knowledge used. A familiar professional title is only a starting point; the written and actual job must fit the selected USMCA entry. Admission planning should follow the current procedure selected for the case. A Canadian citizen generally presents the TN evidence to a CBP officer at a port of entry or preclearance location and does not need a TN visa, while the employer may instead file Form I-129 with USCIS in advance; a Mexican citizen generally applies for a TN visa at a U.S. consulate first. Those procedural options do not change the need for a qualifying professional assignment. Do not schedule productive services merely because a letter has been drafted or a customer expects a worker. Preserve the admission record and compare its dates with the terms described in the support material.

02

Match the qualifying credential

The relevant TN entry controls the degree, licence, experience, or combination that may be accepted. Locate original diplomas, transcripts, and any necessary professional licence. If a qualification was issued outside the countries named in the governing rule, obtain a reliable evaluation where needed rather than assuming an employer’s assessment supplies equivalency. Licensing is a separate practical issue. A credential may fit the listed occupation and still leave a state-specific licence, registration, supervision, or employer requirement to investigate before practice begins. Conversely, a local occupational label should not be used to invent a TN category. Name the proposed jurisdiction and the regulated activity, then seek reliable confirmation of the relevant professional rule. This prevents immigration documentation from being used as a substitute for permission to practise.

03

Keep employment distinct from ownership

Name the employer, any customer, the site of performance, compensation, duration, and supervising structure. TN permits some third-party arrangements, but a business interest can raise a self-employment concern when the applicant controls the receiving U.S. enterprise. A nominal manager or an unsigned description should not be used to conceal the real arrangement. Temporary intent is supported by the overall plan, not by a formulaic promise. Record the assigned duration, continuing foreign ties where relevant, and the reason the professional services have a defined U.S. purpose. Do not make statements that conflict with a permanent job offer, business acquisition, or family timetable. If the proposal changes, reassess it. A precise timeline is more credible than a vague assertion that every future option has been ruled out. Finally, keep the requested period tied to the real assignment. Extension, change, or renewed-entry planning should use the then-current duties and documents, not an older letter copied forward without review. The professional list, qualification, work relationship, and temporary purpose should remain aligned whenever material facts change. Keep all records dated and identify any future extension or changed assignment as a new fact requiring fresh comparison with the TN elements.
