May an E dependent spouse work for another business?

THE DIRECT ANSWER

A qualifying E spouse may generally work based on valid dependent classification and suitable status evidence; children do not receive the same work benefit.

Plan each person’s participation

A household in which the spouse expects independent employment should be analysed from the actual proposal, not from an abbreviated label in an email or a planning spreadsheet. The investor must be able to direct and develop the qualifying enterprise, while a dependent spouse’s separate employment plan does not turn the spouse into the business operator or investor. Start with the facts that exist today: names of parties, dates, duties, ownership rights, payments, and any condition that could change the arrangement.

A future intention can be useful context, but it should not be presented as an accomplished fact. Retain relationship documents, passports, admission evidence, intended job information, and school documents separately from the enterprise file. Keep originals available and make translations complete where the chosen process calls for them.

If a document is unavailable, explain the gap accurately rather than filling it with an assumption. A child can attend school, but a proposed job, internship, or family-business role needs its own work-authority analysis. That person’s nationality, status record, age, planned study, and planned activity may require a separate review.

Government fees, filing locations, visa availability, and procedural instructions can change, so confirm them from the current official source before money is committed or travel is booked. Check current documentation standards before the spouse starts employment, and keep any licensing question distinct from immigration status. The purpose of preparation is a clear factual record and an informed route comparison; it is not a promise that an officer will reach a particular result.
