Your expertise.Across borders.

An employee who has trained colleagues in an internal method should explain their own knowledge without claiming that nobody else can possess it. L-1B requires specialized knowledge and qualifying transfer facts. Sharing knowledge within a company does not make a generic exclusivity claim an appropriate substitute for evidence of the actual expertise. An L-1B assessment should distinguish company-specific expertise from general industry experience. It requires a qualifying organization, a continuous qualifying year abroad during the preceding three years, and a U.S. role needing specialized knowledge in substance. L-1B time in the classification is subject to a five-year maximum. The first review should identify the company's product, process, service, research, equipment, management, or other interest and the applicant's unusually developed knowledge of it. The file should identify the U.S. business need in concrete operational terms, then test it against the applicant's documented knowledge. This avoids an otherwise strong product narrative that never explains why this transferee is needed for this assignment. Keep the knowledge account focused on the applicant's demonstrated work and the role actually proposed. That discipline avoids adding broad claims that distract from the specialized-knowledge analysis.

01

Describe the knowledge and the applicant’s level

Hypothetical example: an employee developed a troubleshooting method and later trained a team to use it. Identify what the employee understands, how it was acquired and which advanced applications remain relevant to the U.S. assignment. Do not say the method is known only to the applicant if records show otherwise. Ask for work artefacts that show the applicant applying the knowledge: controlled procedures, problem records, internal certifications, change histories, or client-delivery materials where appropriate. A polished reference letter is stronger when it points to a record that can be checked. Avoid claiming the knowledge is secret unless the company can accurately support that description. The decision is whether the U.S. role genuinely requires this particular level of organizational expertise.

02

Connect teaching with actual application

Set out either special knowledge of the organization’s interests and its international application or advanced knowledge of its processes and procedures. Training others can be part of the factual history, but the case needs more than an instructor title. Use concrete work examples instead of equating seniority or popularity as a trainer with the standard. Separate introductory instruction from the applicant's own advanced use of the method. Identify the consequences of an error, the adaptations the applicant makes, and why ordinary onboarding would not immediately supply the same capability. Training slides alone may show that information exists without showing the applicant's level. A review should produce a concise comparison between standard users, experienced users, and the proposed transferee.

03

Establish the qualifying entities and employment

Document the corporate relationship, ongoing business and continuous qualifying year abroad within the relevant three-year period, with individual timing reviewed. Describe the intended U.S. services. The applicant’s technical contribution does not establish the legal employer or qualifying organization without separate evidence. Active U.S. and foreign entities must be related as parent, branch, subsidiary or affiliate. A new L-1B office receives no more than one initial year and must show sufficient premises plus financial capacity to pay the employee and start doing business. Customer-site work must be petitioner-controlled rather than labour-for-hire, and the L-1B limit is five years. Confirm the qualifying relationship and foreign employment period with records from the entities themselves, then connect those facts to the intended U.S. assignment. Do not let product knowledge obscure a gap in the transfer history. If the role changes while preparation is underway, revisit which knowledge will actually be used. A defensible filing describes the current assignment, not an idealized one from an earlier business plan.
