Your talent.A bigger stage.

TN is a temporary classification for Canadian or Mexican citizens undertaking an arranged professional assignment in an occupation listed by the USMCA. It is not a general work option for any skilled job. The file needs a real U.S. employer or other qualifying engagement, duties that fit the listed occupation, and the credential or licence required by that specific listing. Canadian citizens generally present the TN evidence to a CBP officer at a port of entry or preclearance location and do not need a TN visa, while the employer may instead file Form I-129 with USCIS in advance; Mexican citizens generally apply for a TN visa at a U.S. consulate first, and the right choice should be checked against current official instructions. A job title, proximity to the border, or Canadian permanent residence alone does not answer the test. Before relying on TN, ask the employer to confirm the role in ordinary operational language and compare that account with the selected professional entry. Preserve versions of the offer and scope that were actually used in the decision. If duties, ownership, customer involvement, or work location changes, revisit the analysis before assuming the original description still fits. The pathway is portable only to the facts it was granted or requested for; it is not a broad credential that follows a worker into any future business arrangement.

Start with the TN eligibility and application overview

01

Start with the day-to-day professional assignment

Hypothetical example: A Canadian environmental specialist is offered a role described as ‘consultant,’ but the work statement includes field sampling, routine data entry, client presentations, and technical reports. The review should identify the recurring tasks, who receives the work, and which listed profession is actually relied upon. A creative title cannot carry an otherwise mismatched role. Conversely, ordinary supporting tasks need not erase a professional role if the evidence shows the essential assignment and the applicant’s professional responsibility. The support letter, contract, and position description should tell the same practical story rather than offering incompatible versions of it.

02

Read the occupation entry before collecting credentials

Each Appendix 2 profession has its own qualification language. Some entries call for a degree, some allow a specified diploma plus experience, and some include licences. Match the applicant’s record to the entry selected; do not borrow a qualification from a similar occupation. If a required credential was issued outside Canada, Mexico, or the United States, a reliable evaluation may be needed to explain its equivalence. Licensing is separate: where the occupation needs authorization to practise in the intended U.S. jurisdiction, determine exactly what activity may occur before assuming the academic document resolves the issue.

03

Keep employment separate from ownership

The petition or admission request should disclose who offers the professional work, who pays, where the services are delivered, and whether a customer is involved. TN does not allow the applicant to be self-employed. An ownership interest must be assessed carefully, especially when the applicant has sole or controlling ownership of the U.S. enterprise receiving services. A nominal manager, a friendly customer, or an informal services agreement does not cure prohibited self-employment. The temporary nature of the proposal should also be explained through the actual assignment, the planned duration, and the applicant’s surrounding circumstances, without inventing a guarantee about future travel.
