FOR IMMIGRANT INVESTORS · POINT EDWARDPoint Edward

Invest in anew chapter.

EB-5 is an immigrant investor programme with statutory and regulatory requirements concerning capital, job creation, lawful source, and process. The investment must place US$1,050,000, or US$800,000 where the project is in a targeted employment area or is an infrastructure project, at commercial risk in a new commercial enterprise, and it must create at least ten full-time jobs for qualifying U.S. workers. Those statutory amounts are subject to adjustment from January 1, 2027, so they should be reverified against current official material before funds move, and the investor must be engaged in the management or policy formulation of the enterprise. Approval of an investor petition is not permanent residence by itself; the immigrant visa or adjustment process follows if available, and qualifying investors first obtain two years of conditional permanent residence. The conditions are later addressed through Form I-829 in the statutory filing window. EB-5 calls for exact financial and project due diligence, not a promise that a project or immigration result is risk-free.

Start with the EB-5 eligibility and application overview

01

Understand capital and commercial risk

The required investment amount can depend on the location and qualifying designation of the project, so use current official material and do not rely on old marketing figures. Capital must be invested or actively in the process of being invested in the new commercial enterprise, and it must remain exposed to gain or loss. A guaranteed return, redemption arrangement, or undisclosed side agreement can conflict with that premise. Read offering documents, subscription terms, loan documents, escrow conditions, fees, and exit provisions together. The immigration question does not eliminate ordinary investment risk; it makes truthful disclosure of that risk especially important.

02

Trace lawful source and path of funds

An EB-5 source record often goes further back than a current bank balance. It may include earnings, tax filings, business ownership, asset purchases and sales, inheritance, gifts, loans, or other events explaining how the investor acquired capital. The path then follows transfers into the enterprise. Each step should have a date, account, amount, and supporting record. A document that proves wealth at one time may not prove lawful acquisition or movement of the particular invested money. Resolve discrepancies directly rather than leaving a reviewer to infer the link.

03

Review the job-creation methodology

Direct investment and regional-center structures can involve different practical evidence and job-count methods. Identify the project’s economic model, the jobs claimed, the responsible parties, the deployment of capital, and the evidence expected at the I-829 stage. A glossy development narrative is not a substitute for understanding the project documents. Ask how construction, payroll, expenditures, and job calculations will be recorded, and what happens if the business plan changes. Independent financial and legal advice may be appropriate for a decision of this scale.

04

Separate petition approval from residence

The investor petition is one stage. If it is approved, the individual still needs an immigrant visa or adjustment process, subject to visa availability and the applicable requirements. Conditional permanent residence generally lasts two years. The removal-of-conditions filing has its own evidence and timing. Keep travel, employment, family, and relocation planning flexible enough to recognize that stages have different decision-makers and timelines. Avoid telling a school, employer, or seller that residence is assured on the date money moves.

05

Prepare for the conditional-residence record

From the moment capital is subscribed or deployed, organize documents with the later I-829 inquiry in mind. Maintain statements, enterprise records, tax information, notices, project updates, and job-creation evidence that relate to the investment. The investor should understand who controls those records and what reporting the enterprise provides. Do not wait until the closing months of conditional residence to discover that a key project document, payment confirmation, or job record is unavailable. A disciplined archive supports both honest reporting and informed oversight of the investment.
