Start with the L-1A eligibility and application overview
Prove the organization before the reporting chart
Hypothetical example: A regional director reports into a shared North American leadership team, while payroll sits with a Canadian subsidiary and the proposed U.S. role is with an affiliate. Explain the legal entities first: parent, subsidiary, affiliate, or branch, along with ownership and control. A slide deck can orient a reader, but share registers, annual records, operating agreements, and comparable primary documents establish the relationship. The file should distinguish corporate governance from a dotted-line reporting arrangement. A common logo, joint project, or overlapping officer does not by itself prove the needed connection between the organizations.
Show managerial or executive capacity in practice
A useful role description identifies decisions, discretion, budget or policy authority, staffing influence, and the professional or operational layers that carry out day-to-day tasks. Direct reports are relevant, but they are not the entire inquiry. A function manager may qualify if the function is essential, the applicant controls it at a senior level, and the organization’s structure supports that account. Do not hide hands-on work that occupies a substantial part of the role. Describe it candidly, then explain the role’s actual focus with examples drawn from ordinary operations rather than generic claims of leadership.
Treat a new office as a staged operating plan
When the U.S. enterprise has been doing business for less than one year, the initial L-1A approval is limited to one year. The record should show secured physical premises and a credible plan for operations that can support a managerial or executive position after that period. State the staffing sequence, revenue assumptions, service delivery, and decision structure. A lease alone does not establish a viable operation; a forecast alone does not establish premises. The plan should be coherent with funding, contracts, hiring, and the applicant’s proposed responsibilities from the first day through the end of the initial period.
Assess the relevant continuous foreign-employment period
The executive definition concerns primarily directing management of the organization or a major component or function, establishing goals and policies, exercising wide discretionary latitude and receiving only general supervision or direction from higher executives, the board or owners. A production manager who supervises fourteen people, sets shift schedules, approves purchases and disciplines staff is doing managerial work. Doing business means regular, systematic and continuous provision, not simply a registered address or an agent. A first-line supervisor of employees who are not professional, managerial or supervisory themselves is generally not treated as a manager for this purpose unless the employees supervised are professionals. Brief business trips to the United States generally do not break continuity, but a longer period of United States employment during the same window can reduce the time available. Owner or major-stockholder cases need the appropriate temporary-services and subsequent foreign-assignment evidence.
