THE SHORT ANSWER

A new-office L-1 plan requires more than a new company registration. It must show qualifying organizations, secured premises, and a credible first-year path to the claimed role. Assign internal owners for each evidence stream: corporate records, premises, finance, hiring, operations, and the transferee’s duties. Review that file at regular milestones during the first year. The business should be able to explain any divergence from its plan with actual decisions and documents, rather than relying on last-minute estimates. That operating discipline benefits the company whether or not an immigration application proceeds on the hoped-for schedule. The applicant’s first-year duties should be revisited as hiring and customer activity develop. A genuine new operation may change, but the record should reveal whether the person is moving toward the claimed managerial, executive, or specialized function. Retain invoices, payroll, meeting records, and role delegations as they arise, with dates and authors clear. Regular review gives the organization time to correct an operational gap with real business action, not retrospective wording.

01

Establish the corporate foundation

Identify the overseas organization, the U.S. entity, and the exact relationship between them with primary corporate evidence. Then document the applicant’s qualifying foreign employment and the proposed L-1A or L-1B capacity. A business plan cannot replace the historic employment or relationship requirement. Explain ownership and control consistently across entity documents, tax records, governance records, and the organization chart. A new office is still part of an intracompany transfer framework, not a stand-alone entrepreneur category.

02

Show premises and an executable operation

Secure physical premises appropriate to the business and retain the lease or other reliable occupancy evidence. Build a first-year plan around actual services or products, funding, marketing, staffing, vendors, customer pipeline, and operational milestones. For L-1A, explain how the venture will support a managerial or executive position after the first year. For L-1B, explain why the organization will support the specialized-knowledge role. A desk, mailbox, or untested forecast cannot carry the whole account.

03

Use the one-year period as a management deadline

Initial new-office approval is limited to one year. From the beginning, retain proof of operations, hiring, revenue activity, contracts, financial accounts, organisational development, and the applicant’s actual duties. Compare events against the plan and record honest reasons for changes. Do not wait until extension preparation to reconstruct the first year. The extension inquiry looks at whether the operating enterprise now supports the claimed role, so contemporaneous records and realistic business decisions are more useful than a polished retrospective narrative.
