Does an EB-5 project guarantee permanent residence?

THE DIRECT ANSWER

No. EB-5 involves investment, petition, visa or adjustment, conditional residence, and removal-of-conditions stages. Each has separate requirements and risks.

Treat the programme as a sequence, not a purchase

A capital contribution can begin an EB-5 strategy, but it does not itself confer an immigration benefit. The investor must satisfy the governing requirements for the petition, and later must complete the applicable immigrant visa or adjustment process if a visa number is available. Once admitted or adjusted, the investor holds conditional permanent residence, which carries a later I-829 removal-of-conditions process.

Job creation, sustaining the investment, and other relevant evidence matter at that later stage. A project sponsor’s marketing statement, broker’s confidence, or historical approval rate cannot rewrite the statute or predict an individual outcome. The enterprise also remains a commercial investment: construction delay, market change, borrower default, operational failure, and document gaps can affect the project.

Ask who prepares which records, how the capital is used, what risks have been disclosed, and how the job model is tested. Immigration counsel, investment advisers, tax professionals, and the investor may each address different decisions. Keep their roles distinct.

A responsible file uses the term ‘conditional’ accurately and avoids promising that any payment will automatically lead to unconditional permanent residence. Review every project document for consistency about fees, timing, capital use, and risk allocation. If the materials conflict, ask for clarification rather than selecting the version that seems most favourable.

The investor’s own notes should record what was understood and which questions were referred to independent advisers.
