Can an E-2 spouse build an independent career?

THE DIRECT ANSWER

A qualifying E spouse may be authorized to work as an incident of valid E dependent classification with appropriate evidence. Children may study but do not receive the same work permission.

Plan the family’s activity without overstating it

The investor should identify each dependent’s intended arrival, study, employment, and travel plans early. For a spouse planning work, confirm the current status evidence that an employer will request and distinguish immigration authorization from professional licensing or local employment rules. The spouse’s work may be unrelated to the treaty enterprise, but it should not be represented as part of the investor’s business plan unless it truly is.

Children can attend school while in E dependent status; a paid role, an unpaid productive placement, or independent business activity needs separate analysis. Dependent eligibility also depends on relationship and age, so retain marriage and birth documents and watch a child’s approach to 21. A family member may choose to remain in Canada, join later, or use another process based on their own circumstances; none of those choices establishes whether the investor can direct and develop the business.

Keep the household timeline alongside, but distinct from, the capital-commitment calendar. That approach prevents a desired school or job date from being used as a substitute for the enterprise’s required facts. Discuss whether a spouse will have an employment offer, professional licensing issue, or business-management role that should appear separately in the plan.

Family contribution can be commercially real, but it should not be exaggerated to cure a weak operating model. Each person’s activity should remain supportable on its own record.
