POINT EDWARD · BORROWING AND GIFTS

A private loan and a government gift should not be described with the same label

USAvisa field guide · 5 minute readReviewed 7 September 2026
THE SHORT ANSWER

Funds may reach an applicant through a private borrowing arrangement and later be used for a program payment. Document both events accurately. The official program’s use of the word gift does not erase the applicant’s repayment obligation to a relative or lender. Hypothetical example: A specialty-pharmaceutical distributor can fund either a qualifying EB-5 project or a Gold Card payment, but its owner expects repayment from a family loan in both scenarios. The decision is not which label sounds better; it is whether the facts meet the distinct requirements and whether the private debt can be documented accurately. Use separate ledgers for loan proceeds, EB-5 capital, project risk, and any payment by the applicant to the U.S. government. Do not allow the government-gift terminology to obscure a private repayment obligation.

01

Describe the private funding terms as they exist

Hypothetical example: a parent advances money on terms requiring repayment, while the applicant calls it a gift because the eventual payment would go to the government. Keep the loan or other arrangement, authority and transfer path accurate. Do not change the private transaction’s description to fit the name of the later payment. Start with the actual loan or gift instrument, parties, collateral, repayment terms, and money trail. The first review should identify which person is entitled to borrow and direct the funds. A private advance remains private even if it will later fund a government payment. Decide whether the record is complete before moving money through accounts that add unexplained steps.

02

Assess EB-5 capital under its own requirements

If the funds are proposed for EB-5, the financing, investor rights, lawful source and path require assessment along with the at-risk investment and qualifying job creation. A lender’s approval does not establish immigration eligibility, and a project’s expected return does not eliminate repayment risk or guarantee approval. An EB-5 investor must also take part in management or policy formulation. The spouse and unmarried children under 21 can derive status, and successful applicants hold conditional residence for two years, with Form I-829 filed in the 90 days before the second anniversary to remove conditions. For EB-5, analyze lawful source and path, capital at risk, and the applicable job-creation evidence. At least ten qualifying full-time jobs per investor are generally required under the applicable rules. An investor initially obtains conditional residence only through the applicable immigration sequence, and removal of conditions uses the actual conditional-residence timeline. A project forecast cannot provide a return guarantee or erase a personal loan.

03

Use the official Gold Card sequence distinctly

The official FAQ uses two distinct payments: a nonrefundable processing fee and, only after successful vetting, a gift to the U.S. government. An approved applicant then proceeds through EB-1 or EB-2, subject to that category’s requirements, admissibility and visa availability. This is neither EB-5 capital nor a promise of residence or citizenship merely because money was paid. Re-check the official charges, instructions and family rules immediately before transferring any funds. Gold Card is not a conventional visa and not an EB-5 investment. The relevant payment is by the applicant to the U.S. government under current official instructions; it is not money placed in a commercial enterprise for return. Successful applicants still proceed through EB-1 or EB-2 subject to the relevant eligibility, admissibility, and visa-availability conditions. Verify official instructions before payment.

04

Compare the current investment and gift requirements

On September 7, 2026, EB-5 required US$1,050,000 generally or US$800,000 for a qualifying targeted employment area or infrastructure project, with a statutory adjustment scheduled for January 1, 2027. Each investor must put qualifying capital at risk and create at least ten full-time positions for qualifying U.S. workers. The Gold Card FAQ then published a nonrefundable US$15,000 DHS fee per applicant and, after vetting, a US$1 million gift for an individual principal or US$2 million for each corporate-sponsored employee. Every eligible joining spouse or unmarried child under 21 carried an additional US$15,000 fee and US$1 million gift. Compare the evidence burden as well as the amount of money involved. EB-5 requires an investment record and job evidence; Gold Card requires accurate official payment handling and does not remove category eligibility. The reader must decide whether a commercial project or gift payment fits the actual objective, funding, and risk tolerance. A marketing slogan cannot make the routes interchangeable.

05

Keep the procedural obligations distinct

After an EB-5 petition is approved, the investor still completes immigrant-visa processing or adjustment and receives two years of conditional permanent residence; Form I-829 is normally filed during the 90 days before that status’s second anniversary. Corporate Gold Card terms separately state a 1% annual maintenance fee and a 5% transfer charge that includes new DHS vetting, and a replacement employee is not approved merely because an earlier corporate gift is reused. State Department and medical expenses may be additional. Gold Card cases proceed through EB-1 or EB-2 only if category eligibility, admissibility and visa availability are satisfied, and the government gift is not an EB-5 investment seeking a commercial return. Keep later steps in separate calendars. EB-5's conditional-residence process is tied to status dates, while Gold Card timing depends on the official process and the underlying EB category. No payment guarantees a residence date. Preserve the private financing records throughout, because their terms remain relevant even after money has left the applicant's account.
