A matrix reporting structure can obscure who employs the applicant, who owns the U.S. entity and what authority the applicant exercises. L-1A requires qualifying organizations and employment plus a managerial or executive role in substance. Explain legal relationships separately from internal reporting conventions. Begin with a legal-entity map rather than an internal organization chart. The review should identify the foreign employer, proposed U.S. employer, qualifying relationship, the applicant's continuous qualifying year abroad in the preceding three years, and the role proposed in the United States. L-1A stay is limited by a seven-year maximum. The practical choice is whether the record supports a transfer now, a new-office launch, or more time developing the operating structure. Before a filing decision, test whether the proposed U.S. position is supported by a real reporting and operating structure. A transfer cannot be made qualifying merely by changing a job title or adding a broad leadership description to a later memorandum. The entity map and duty record should be reviewed together before submission. If either changes, determine whether the proposed role still rests on the same qualifying facts rather than assuming a corporate update is immaterial.

Map legal entities before dotted reporting lines

Hypothetical example: a manager reports to a regional leader employed by another group company while payroll remains with the foreign employer. Identify the entities and actual relationships. A reporting line does not by itself establish ownership or a qualifying corporate connection to the U.S. employer. Collect formation records, ownership records, and any control documents before relying on a familiar brand name. A dotted reporting line may help explain operations but cannot prove a parent, branch, affiliate, or subsidiary relationship. The first review should identify one person who can explain each entity's ownership and one document that independently confirms it. That prevents a filing from blending corporate vocabulary with unsupported conclusions.

02

Describe authority and underlying work

Explain the applicant’s decisions, discretion and responsibility, and who performs operational tasks. If authority is shared, identify the limits and how decisions are made. A manager title attached to a matrix team does not automatically establish a qualifying role, and direct-report counts are not the only relevant evidence. Use calendars, approval records, budgets, delegation instruments, and descriptions of subordinate functions to show how authority operates. The question is not whether the applicant is busy; it is whether the applicant primarily directs a qualifying organization, department, function, or executive activity. If the applicant is still performing the business's core day-to-day service, explain why and decide whether the role is sufficiently developed.

03

Document employment and operating requirements

Establish the continuous qualifying year abroad within the relevant three-year period, subject to individual timing, and ongoing qualifying business. If the U.S. proposal is a new office, sufficient premises and a managerial or executive role supported within one year are required for L-1A, with initial approval limited to one year. The required corporate link is a parent, branch, subsidiary or affiliate relationship between active U.S. and foreign operations. Work at a customer site cannot be labour-for-hire and must stay controlled by the petitioner. Seven years is the L-1A maximum. Sequence corporate evidence, employment evidence, and U.S. role evidence so each record supports a defined proposition. For a new office, premises, hiring plans, financial capacity, and a one-year organizational path deserve separate examination. Initial new-office approval is for one year. Do not use a planned title to bridge a missing operating record; preserve what existed when the request was prepared.
