Hypothetical example: Étienne Charbonneau is director of field operations for a wind-turbine service contractor based in Lambton Shores, running four crews that maintain gearboxes, blades and control systems across the county's turbine fleet. His employer's holding company has bought an established service firm in Ohio and wants him to run it. On paper this is the textbook L-1A transfer. In practice the petition will turn on a question nobody in the company has yet asked out loud: whether directing four crews of field technicians is managerial capacity as the statute defines it, or first-line supervision with a senior title attached.

Start with the L-1A eligibility and application overview

01

The corporate link has to be ownership, and it has to be evidenced

An L petition requires a qualifying relationship between the Canadian employer and the American entity — parent, branch, subsidiary or affiliate — and both must be actively doing business, meaning the regular, systematic and continuous provision of goods or services rather than merely existing on a register. Because the Ohio firm was acquired rather than founded, the relationship is straightforward to establish and easy to under-document. What proves it is not a statement in the petition letter but the acquisition agreement, the closing share transfer, the updated register of members, the articles of both companies and the organizational chart of the group showing the percentage held at each level. Where a holding company sits between the two operating businesses, every rung of that ladder needs the same treatment. Ongoing operations are shown separately, through payroll records, contracts, invoices and tax filings on both sides of the border.

02

Directing crews is not the same as managing in the statutory sense

Managerial capacity is defined by what a person manages, not by how many people report to them. A manager either supervises and controls the work of other supervisory, professional or managerial employees, or manages an essential function of the organization at a senior level, and in either case exercises discretion over day-to-day operations. Étienne's technicians are skilled, but if they are not themselves supervisors or professionals, supervising them directly is first-line supervision, and the petition has to rely on something else. The realistic answer for a service business is usually the function branch: he does not merely dispatch crews, he owns the maintenance programme itself — the scheduling model, the parts and consumables strategy, the safety and competency regime, the contract performance guarantees. Executive capacity is a different test again, concerned with directing the management of the organization and setting goals and policy with only broad supervision from above.

03

A year abroad that is continuous, qualifying and recent

The petition must show one continuous year of employment with a qualifying entity abroad within the three years immediately before filing, and that year must itself have been in a managerial, executive or specialized-knowledge role. Two facts commonly damage this element in a cross-border service business. Short assignments in the United States for the same group do not break the continuity of the Canadian employment, but neither do they count toward the year, so a technician-turned-manager who has been shuttling to American sites may have less qualifying Canadian time than the calendar suggests. And a promotion inside the year matters: if Étienne only moved into the operations directorship eight months ago, the earlier months have to qualify on their own terms or the year is not complete. Payroll records, dated appointment letters and reporting-line documentation are what settle this, not recollection.

04

The clock, and who else on the team may not need a petition at all

An L-1A transferee to an established U.S. entity is ordinarily approved for up to three years initially, extended in increments, with a total ceiling of seven years; the L-1B ceiling is five. Time counted against those ceilings is time spent in the United States, so a manager who spends part of each year in Canada is not consuming the limit at full speed, and time spent physically outside the United States can generally be recaptured with evidence, while a continuous year or more abroad can open a fresh period of stay. Planning for the seven-year horizon belongs at the start, because it decides whether a permanent route is eventually needed. It is also worth checking who actually needs an L petition. A mechanical engineer joining the Ohio operation and the group's market economist are both occupations listed in USMCA Appendix 2, and a Canadian citizen in either role may have a far shorter path than a petition, provided the position genuinely consists of that professional work.
