Your talent.A bigger stage.

Hypothetical example: Ingrid is a Canadian citizen who runs the analytical bench at a specialty lubricants blender in Petrolia, holding an honours bachelor of science in chemistry and eleven years at the same instrument set. A refinery-services company in Ohio has offered her a post it calls senior laboratory technologist, testing base oils and additive packages against published specification. Two entries in USMCA Appendix 2 could describe that work: Chemist, and Scientific Technician or Technologist. They impose different requirements, they are proved by different evidence, and the American company has written a job description that sits uncomfortably between the two.

IN THIS GUIDE · A chemist deciding which of two entries on the professional list her American job really falls under

Start with the TN eligibility and application overview

01

The two entries ask different questions and only one of them is about her degree

The Chemist entry is satisfied by a baccalaureate or licenciatura degree, and the enquiry stops at the applicant. The Scientific Technician or Technologist entry reaches applicants without a degree, but it attaches two conditions that have nothing to do with schooling: theoretical knowledge of a listed scientific discipline, chemistry among them, and work performed in direct support of a professional working in that same discipline. That second condition imports a fact about the American workplace. If no qualifying chemist is employed at the receiving laboratory, the technologist entry has nothing to attach itself to, however capable the applicant. Ingrid holds the degree, so the simpler entry is available to her, and the harder question is whether the position matches it.

02

Which entry is available is decided by the job description, not by the applicant

A post that involves selecting methods, interpreting anomalous results, developing a test where none exists and signing off on findings is professional chemistry, and the Chemist entry fits without strain. A post that involves running validated methods on a schedule, logging results and escalating exceptions to a supervising chemist is technologist work, and it must be documented as such. The American draft mixes both, adding customer complaint handling and internal audit duties that belong to neither. The employer should decide what it is actually hiring, describe that plainly, and let the entry follow. Rewriting a description to suit a preferred entry inverts the exercise and produces a document contradicted by the first week of work.

03

What this route will not stretch to cover, however strong the credential

Self-employment in the United States is outside TN entirely. If the Ohio company preferred to retain her as a contractor invoicing through her own Ontario corporation, that structure would be examined closely, because she owns the corporation standing on the other side of the contract; it is workable only where the American entity genuinely directs the work and she is not establishing a practice of her own in the United States. She must be employed by, or engaged under contract to, an American entity that directs her work. Any equity she is offered in that entity has to be disclosed and will be examined for whether the relationship is genuinely employment rather than a proprietorship in disguise. The work must also be prearranged. Travelling first and looking for the position afterwards is not what this category permits, and describing an exploratory trip inaccurately at the border creates a problem that outlives the trip.

04

How a Canadian citizen applies, and what a change of plan requires

Canadian citizens ordinarily present themselves at a class A land port of entry or at a preclearance facility and seek admission without first obtaining a visa. The alternative is for the employer to file Form I-129 with USCIS and for the approval to be presented on arrival, which suits employers who want certainty before a start date. Mexican citizens ordinarily use the consular visa process instead. Admission is granted for a period not exceeding three years and is tied to the employment described in the supporting letter. Citizenship is the qualifying fact: Canadian permanent residence, however long held, does not open this category. A material change of employer or of duties calls for a fresh application rather than an explanation at the next crossing.
