Can the franchisor approve my spouse as operator before their status is settled in Sarnia?

THE DIRECT ANSWER

Commercial approval does not establish the spouse’s work authorization. Record both the proposed operating role and the immigration status that would permit it.

Keep the franchise role and status record distinct

A qualifying E spouse may work incident to valid status with appropriate evidence. That benefit does not apply merely because the franchisor names the spouse, and the principal still must meet development-and-direction requirements. Review each person’s actual duties and status before beginning U.S. operations. Dependent children do not receive the same spousal work benefit.

Hypothetical example: A treaty-national owner of a specialty tea importer wants a spouse to supervise purchasing and a high-school child to assist at weekend events. Start with each person's status, relationship evidence, and planned U.S. activities. The first review should make clear that a qualifying E spouse may be employment authorized incident to valid status with appropriate evidence, whereas dependent children do not receive that same work benefit. The principal must still show development and direction of the real enterprise. Do not use a family title on the business plan to bypass work-authorisation questions. Sequence staffing commitments after confirming the actual status records. Problems arise when a child performs regular productive tasks, when a spouse's duties are never documented, or when the business begins operating before the principal's own classification is in place. Keep school, travel, and work plans distinct.

Make staffing decisions after the household's lawful roles are understood. A business plan should not assign revenue-critical work to a child who lacks the relevant work authorization.
