SARNIA · PARTIES TO THE ASSIGNMENT

A customer’s site instructions should be connected to the employer’s offer

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

When work is performed for a customer, explain how the offer and site scope describe the same assignment. The customer may know the daily tasks while the employer controls employment terms. A TN file needs an accurate account of both, with unresolved differences identified. Hypothetical example: A hydrologist's employer offers a water-quality role, while the customer expects environmental permitting support and has not confirmed the final site. The reader must decide whether the records describe one definite professional assignment or a proposal that needs clarification. Start with a responsibility table showing who can verify employment, duties, worksite, supervision, and duration. That table becomes the checklist for resolving differences before a TN process is selected. The deciding next step is to reconcile the current scope before anyone signs a support letter. A clear factual record is more valuable than a polished package built around an assignment that may still change.

01

Identify what each party can confirm

Hypothetical example: a laboratory customer specifies analytical methods and daily priorities, while the employer’s offer contains only a broad chemist title. Obtain the actual scope and employment terms. Ask the relevant party to confirm facts within its knowledge rather than making one writer adopt another party’s unsupported statements. Obtain direct, dated confirmation for the facts each party controls. The employer should not attest to technical details it has never received, and the customer should not invent compensation terms. Where a record conflicts with another, preserve both and explain the actual change. A first review should leave a short issue list with an owner and source for each unresolved item.

02

Keep professional qualification separate from the site label

TN requires qualifying Canadian or Mexican citizenship, prearranged professional activities and temporary entry. The chemist entry lists a baccalaureate or licenciatura degree. The degree and the actual work must be assessed together; a laboratory location or customer endorsement does not establish the listed qualification or make every routine task professional chemistry. Decide the claimed TN profession from the real duties before focusing on formatting. Match the credential evidence to that profession and identify any work that falls outside the account. A customer request for help is not enough by itself. The useful result is a support package in which title, degree, and work description tell the same accurate story.

03

Prepare records without hiding differences

Compare the agreements, duties, compensation and intended duration. Explain any ownership of the receiving entity, including the prohibited sole or controlling self-employment issue. Foreign degrees from institutions outside Canada, Mexico and the United States require reliable evaluation, and foreign-language USCIS submissions require complete certified English translations. Neither should be used to smooth over contradictory job facts. Canadians may apply for TN status at a port of entry or through an employer’s Form I-129 and generally require no visa stamp. TD dependants can study, but employment is barred. Choose a process only after the assignment and evidence are stable. A Canadian applicant may seek TN classification upon entry or preflight inspection, while an employer may use Form I-129 submitted to USCIS when petition processing is appropriate. The classification does not allow self-employment where the applicant has sole ownership or control of the recipient enterprise. Make that ownership decision explicit rather than relying on a nominal customer arrangement.
